Terms of Service
With my registration I agree to the following conditions:
1. scope
Dorfgmües, owner R. Klarer, based in 8800 Thalwil (hereinafter "Dorfgmües") provides the agreed delivery or provision of vegetable subscription bags exclusively on the basis of the following general subscription agreements.
2. registration
It is possible to register for a new subscription at any time, provided that the seasonal vegetables are available in sufficient quantities.
3. Subscription sizes and prices
There are two subscription sizes:
• Small for CHF 27.-/week
• Family for CHF 38.-/week
The prices for all subscription options are based on the market prices for organic vegetables produced in Switzerland. The effective merchandise value of the vegetable bag contents varies throughout the season.
For the home delivery option, we charge CHF 4.-/week in addition to the subscription price.
With a new registration you will receive two Dorfgmües shopping bags. We charge a deposit of CHF 20 for this, which you get back when you cancel your subscription and return the bags.
4. quality of the products
In the vegetable bag you will find seasonal vegetables from Dorfgmües. We value a varied range and absolute freshness. Various factors as well as the whims of nature have an influence on the harvest: the size, weight and quality of the vegetables can vary weekly, seasonally and annually. In exceptional cases, we may buy vegetables from regional organic producers.
5. Collection/home delivery/depot stations
Dorfgmües provides vegetable bags from the beginning of May to the end of November. The aim is to provide a vegetable bag for 30 weeks a year. In the event of very bad weather conditions, we reserve the right to postpone the start of the season by two weeks. If the season starts late, you will be informed in good time by email, at least two weeks in advance.
Collection: The vegetable bags can be obtained from the Dorfgmüesgärtnerei in Thalwil Mettli on Thursdays.
Home delivery: The vegetable bags are delivered to your home on Thursday evenings. The exact time of delivery cannot be chosen. If no one is able to accept the vegetables at the time of delivery, we will deposit the vegetable bag at the front door or at a previously agreed location at your address.
Depot stations: If there are at least 4 subscribers, we will set up a depot station in the relevant community/district if possible. The depots are filled on Thursday evening and emptied again on Friday evening.
Liability on the part of Dorfgmües for damage to the vegetables that occurs during interim storage (e.g. theft, heat, cold, etc.) is hereby explicitly excluded. This applies to both the home delivery option and the deposit withdrawal option. If the item is not picked up, there is no right to a replacement.
The exact collection and delivery times are published on our website.
6. delivery area
Our delivery area for home delivery currently includes the following communities: Thalwil, Horgen, Oberrieden, Rüschlikon, Langnau a. albis
If there are at least 4 subscribers, we will set up a depot station in the relevant community/district if possible. This must be on the left side of Lake Zurich, between Horgen and Zurich. The current depot stations can be found on the Dorfgmües website.
7. Change of home delivery, depot, pick-up option
During the ordering process for a vegetable subscription, it must be specified whether home delivery, collection from the field or collection from a depot is required. During the season, you can switch from the pick-up option to the depot option or vice versa at any time, provided the desired depot station still has free spaces. The desire to change must be communicated to Dorfgmües at least 5 days in advance by email.
A change from the home delivery option to the depot or pick-up option or vice versa is only possible once during the season. The desire to change must be communicated to Dorfgmües at least 5 days in advance by email.
8th. subscription breaks
As a small vegetable farm, Dorfgmües relies on precise cultivation and harvest planning. It is therefore not possible to take subscription breaks, for example when you are away on vacation. However, it is possible to pass the vegetable subscription on to someone you know when you are away. Changes to the delivery address during the absence will be taken into account, provided the address is in the Dorfgmües delivery area. The change of address must be communicated to Dorfgmües at least 5 days in advance by email.
9. payment of the subscription
You pay for the vegetables in the subscription at the beginning of the season, at the beginning of May. Alternatively, the subscription can be paid in three installments. The payment option is chosen during the ordering process. When paying in installments, the first installment is paid at the beginning of the season, at the beginning of May. The second and third installments are paid in early August and early November. If you register during the current season, the subscription amount will be billed pro rata (remaining time until the end of the season). The term of payment is 30 days from invoicing.
If the contents of the bag are completely or significantly smaller than planned, ie less than four types of vegetables, we will credit you with the difference between the subscription price and the price by the end of November. We calculate the amount based on Bio-Suisse's price recommendations for direct marketers. Minor shortfalls will not be credited, but will be compensated in terms of quantity if possible with one of the following vegetable distributions.
10 Unsubscribe
A vegetable subscription can always be canceled at the end of a season (30 November). We must receive the notice of termination in writing by e-mail no later than the middle of the month of notice (November 15). If you do not cancel, you will automatically be a vegetable subscriber again for the next year.
11. Changes to Subscription Agreements
Dorfgmües reserves the right to adapt the present subscription agreements to changed circumstances. You will be informed of changes to the subscription agreements in writing by e-mail by October 15 at the latest. If you do not cancel your subscription in due time, the new subscription agreements will be deemed accepted for the continuation of the subscription.
12. Governing Law/Jurisdiction
In the event of disputes, Swiss law is exclusively applicable. The place of jurisdiction for orders by customers is the customer's place of residence or the domicile of Dorfgmües.
